Note on the problem of own content and external links

As a content provider according to §8 of the Teleservices Act, the person responsible is responsible for his own content, which he makes available for use, according to general laws. A distinction is to be made between this own content and cross-references ("links") to content provided by other providers.

Links are always cross-references to "living" dynamic content. When the link was first established, the person responsible checked the external content to determine whether it might trigger civil or criminal liability. However, he does not constantly check the content to which he refers in his offer for changes that could give rise to a new responsibility. If he discovers or is pointed out by others that a specific offer to which he has provided a link triggers civil or criminal liability, he will remove the reference to this offer.
